Mandatory PAIA Section 83(4) Reporting for Private Bodies

Private bodies in South Africa are now required to submit an annual PAIA Section 83(4) report to the Information Regulator, as per the regulator’s recent notice. This report is a statutory obligation under the Promotion of Access to Information Act (PAIA).  The purpose is to provide the Information Regulator with data on requests for access to records held by private bodies.


Submission Guidelines:

  • Portal Registration: Private bodies must register on the Information Regulator’s e-services portal.

  • Submission Period: The report for the financial year 2023/2024 must be submitted between 1 May 2024 and 30 June 2024.

  • Accuracy and Detail: It is crucial to provide complete and accurate information to avoid receiving information notices for insufficient data.


Consequences of Non-Compliance:

  • Deadline: The final date for submission is 30 June 2024.

  • Compliance Assessment: Missing the deadline may trigger a PAIA compliance assessment by the regulator.

  • Legal Implications: Non-compliance could lead to an own-initiative PAIA compliance assessment under Section 77H(1) of PAIA.
