The Employment Equity Amendment Act (EEA) introduces significant changes to South Africa's employment equity landscape, with a structured implementation timeline spanning from January to September 2025. January 2025: Initial Implementation Phase
The Act came into effect on 1 January 2025, marking a crucial starting point for designated employers. From this date, employers must demonstrate a clean record regarding discrimination and harassment. Any adverse findings by the Commission for Conciliation, Mediation and Arbitration (CCMA) or courts related to unfair discrimination or harassment will result in the denial of compliance certificates.
February 2025: Sectoral Consultations – Ministerial Targets
A final round of consultations will take place with the 18 identified sectors regarding Ministerial Targets. These discussions will be crucial in determining sector-specific employment equity targets and requirements.
March 2025: Gazetting and Regulatory Framework
The draft Ministerial Targets are expected to be gazetted for final public comments until the end of March 2025. This will be followed by the promulgation of new regulations that will include:
