			<content:encoded><![CDATA[<p>CAPE Town will get its own consumer tribunal next month. It will run like a court and allow people to get redress from errant companies.<br />
The National Consumer Forum has welcomed the establishment of the tribunal, saying it’s a chance to level the playing field between consumers and businesses.</p>
<p>The Western Cape office of the Consumer Protector received just more than 9 000 complaints from the public last year and resolved 6 000 of them.</p>
<p>While thousands more are still being processed, the 20 which have resulted in stalemates between the complainants and the companies will be the first cases referred to the tribunal.</p>
<p>The tribunal, which will be based in the city but will move wherever it is needed in the province, is being established in terms of the Consumer Protection Act.</p>
<p>Panel members, or trialists, who must hear arguments and rule on the outcome, are drawn from a range of backgrounds.</p>
<p>They include an advocate with more than 25 years’ experience, a lawyer, a former businessman and a consumer advocacy group representative.<br />
Advocate Ashley Searle, the director of the provincial office of the Consumer Protector, said the tribunal would operate in the same way as a court.</p>
<p>Unresolved disputes would be referred to the tribunal.</p>
<p>Before a case could be heard, subpoenas and summonses would be issued. Pre-trial hearings would have to be completed before the formal “trial” could begin.</p>
<p>These processes were prescribed by law.</p>
<p>Every consumer whose case goes before the tribunal will be represented by the Consumer Protector. The company against whom a complaint is made will be allowed to hire a lawyer.</p>
<p>After the case has been proved, with evidence of a transgression, the tribunal will make a decision and will have the authority to compel the company to refund the consumer, or order it to replace the product.</p>
<p>The tribunal could even order the company to pay compensation to the consumer.</p>
<p>“This legislation means that we will now be able to ensure that the rights of consumers in the Western Cape are fully protected,” said Searle.</p>
<p>National Consumer Forum chairman Thami Bolani said the tribunal could be the element needed to level the playing field between consumers and businesses.</p>
<p>But, he cautioned, it was still vital that consumers be educated about their rights and that the offices of the Consumer Protector were “highly visible” and easily accessible.</p>
<p>Other provinces would get tribunals in the coming months.<br />
Gauteng already had a consumer court.</p>
<p>Bolani said most consumer complaints came from the Western Cape, Gauteng and KwaZulu-Natal.</p>
<p>Most of the complaints received by the National Consumer Forum had been about the motor industry. The forum had been flooded with calls during the festive season about defective cars and dealers who refused to acknowledge the vehicles’ problems.</p>
<p>Another serial offender was the cellphone industry, Bolani said.</p>
<p>Many people had been locked into contracts without fully understanding the terms.</p>
<p>The forum had also received a number of complaints about the food industry, particularly smaller retailers.</p>
<p>Bolani said he was optimistic about what the tribunal could do, but that the proper enforcement of rulings was critical.</p>
<p>Western Cape Tourism and Economic Development MEC Alan Winde said the tribunal was in line with provincial legislation and the guidelines laid out in the Consumer Protection Act.</p>
<p>“The legislation has never been an issue for those responsible companies who endeavour to give the best service,” said Winde.<br />
He said the tribunal would deal with companies that did not abide by the rules.</p>

The move was prompted by the Federation of Unions of SA (Fedusa) writing a letter on 18 November to the presidency requesting an extra public holiday because Christmas fell on a Sunday last year and the Day of Goodwill on a Monday.<br />
To quote the presidency spokesperson: &#8220;Based on their recommendations, the president approved the public holiday.&#8221;<br />
The late move prompted strong reactions from various Business and Commerce Chambers countrywide, bemoaning the impact on business in the country.<br />
Economists viewpoints were varied with some supporting the Chambers’ viewpoint, whilst others did not suspect such a substantial impact as a number of businesses are closed over this period in any event.<br />
The net impact on your business is that the day must be treated as any other public holiday and the provisions of the Basic Conditions of Employment Act or any agreement or determination binding on you would be of application.</p>

			<content:encoded><![CDATA[<p>The final negotiation for the year took place on the 13th of December. There are enormous time pressures to finalise the changes and this is not assisted by the fact that the process is becoming strained and adversarial.<br />
There has been slow progress on 4 of the 6 themes (Atypical employment relationships; Dispute resolution; Compliance and enforcement; and Collective bargaining) to date with parties attempting to arrive at the fairest draft legislation under the circumstances.<br />
At this last meeting parties agreed on the way forward.<br />
The Department of Labour stated that the documents need to be cleaned up. There are a few areas of disagreement, however, where there is, it will be recorded as such on the table. The Minister of Labour has indicated that it is time to move on and her intention is to take the proposals to Cabinet at the first Cabinet meeting after the meeting discussed herein. The Cabinet will be very busy for the first quarter of the year however the Department of Labour will attempt to submit to Cabinet by February or alternatively March. The Department of Labour said the social partners should continue talking during this time. This has been met with a certain amount of disagreement, however NEDLAC will meet once a week starting from around 15 January to finalise this process and tackle the final two themes: Equity as well as Access to Employment. The process is reaching its conclusion, however we undertake to keep you updated and to continue to protect your interest in this negotiation period. </p>

<p><strong>Workers Need Written Contracts of Employment to Protect Their Rights</strong></p>
<p>Luphert Chilwane of the New Age spoke to experts about the fact that many employees are still working without formal contracts of employment, which can lead to problems when dealing with disputes or the CCMA.</p>
<p>Labour law expert Jonathan Goldberg told Chilwane that when there is no formal contract, a labour dispute becomes as case of the employer’s word against the employee’s. 			<content:encoded><![CDATA[<p>Due to the implementation of the revised Regulations of the Preferential Procurement Policy Framework Act (PPPFA), effective 7 December 2011, all tenders that are evaluated and awarded by government will consider bidders’ BEE scorecards. </p>
<p>There are a number of factors that need to be considered when evaluating a scorecard to ensure companies that are fronting don’t leak through the cracks.  Evaluating a B-BBEE scorecard can be both tedious and complex. Specific details can make a tremendous difference to the validity of the scorecard. </p>
<p><strong>Is your procurement officers and government tender committee members sufficiently trained to technically evaluate the BEE Scorecards?</strong> </p>
<p>To assist you in this regard, we have compiled a practical workshop which we can present on an in-house basis, aimed at all officials involved in the tender process.  This hands-on course will enable delegates to understand the process so that they are able to properly evaluate the B-BBEE section of tenders.  </p>
