CAPE Town will get its own consumer tribunal next month. It will run like a court and allow people to get redress from errant companies.

At the commencement of the arbitration concerning the applicant’s dismissal for alleged incapacity, he raised an objection to the respondent leading evidence about the contents of a certain tape recording, which he alleged had been unlawfully obtained. Out of the blue and on exceptionally short notice, the 27th of December was declared a public holiday.
The move was prompted by the Federation of Unions of SA (Fedusa) writing a letter on 18 November to the presidency requesting an extra public holiday because Christmas fell on a Sunday last year and the Day of Goodwill on a Monday.
To quote the presidency spokesperson: “Based on their recommendations, the president approved the public holiday.”

The final negotiation for the year took place on the 13th of December. There are enormous time pressures to finalise the changes and this is not assisted by the fact that the process is becoming strained and adversarial.
There has been slow progress on 4 of the 6 themes (Atypical employment relationships; Dispute resolution; Compliance and enforcement; and Collective bargaining) to date with parties attempting to arrive at the fairest draft legislation under the circumstances.
